Acknowledgement of Risk and Disclaimer

THIS DOCUMENT CONTAINS IMPORTANT INFORMATION AND EXPLAINS THE RISKS INVOLVED IN TAKING PART ROLLER SKATING AT MR BROWN’S ROLLER DISCO.  IT ALSO EXPLAINS YOUR RESPONSIBILITIES AND SCOPES WHAT OUR RESPONSIBILITIES ARE.

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING

YOU MUST BE 18 OR OVER TO AGREE TO THESE TERMS 

We are Mr Brown’s Roller Disco. If you would like to take part in a Roller Skating session or would like any minor (someone under the age of 18) who you are responsible for to take part in a Roller Skating Session, then you need to read and agree to the terms set out in this document.  We consider that you are responsible for a minor where you are their parent or guardian or are otherwise responsible for them at the session.

1.               WHAT ARE THE RISKS IN TAKING PART IN A ROLLER SKATING SESSION?

1.1             I acknowledge that taking part in a Skating Session at Mr Brown’s Roller Disco involves some risk.  It is a physically demanding activity involving skating with other people in a group session. Activities include games such as musical statues, corners, wipe-out and limbo all done on skates.

1.2            As part of our sessions, we us laser lighting and UV lighting which can restrict vision. I acknowledge that skating during this period will be of a slightly higher risk due to the lighting and I will make sure that I take extra care while skating at this time.

1.3            The risks in taking part in these activities can include, amongst other things, physical injuries e.g. cut, bruises, sprains and broken bones. There is also the possibility of suffering more serious injuries such as head and neck injuries.  You may also lose or damage your personal property e.g. mobile devices, watches, jewellery and clothing.

2.               WHAT HAPPENS IF I HAVE ANY INJURIES OR MEDICAL CONDITIONS?

2.1            I understand that I need to have a reasonable level of fitness to participate in Roller Skating and that I need to ensure that any minor I am responsible for meets this requirement. I therefore agree that I will not (and will ensure any minor I am responsible for will not) take part in Roller Skating if this is against medical advice or if the person taking part in the session is pregnant or has any condition which would mean that taking part would be dangerous to them or detrimental to their health or would make an existing medical condition worse. This could include taking part with any of the following conditions head, back or neck injuries, injured limbs, a heart condition. If I am in any doubt, I will seek medical advice. 

2.2            I acknowledge that Mr Brown’s Roller Disco may refuse to allow any person to take part in a Roller Skating session if it has concerns over their health or fitness to take part.

3       HOW WE REDUCE THE LIKELIHOOD OF PHYSICAL INJURY AND LOSS OR DAMAGE TO YOUR PROPERTY:

3.1            We reduce the likelihood of physical injury and loss or damage to property by providing a safety briefing to all people participating in our Roller Skating sessions as Mr Brown’s Roller Disco. I acknowledge that if I am taking part in a skating session, I must watch listen to this briefing and if minor’s I am responsible for are participating I must make sure that they also listen. 

3.2            I acknowledge that if I have any questions in relation to my safety then I will raise these questions before participating in the skating sessions. I will also ensure that any minor I am responsible for has understood the briefing and will ask that you explain it to them if they have not understood it.

3.3            We also have marshals at each skating session and YOU MUST follow their instructions and advice and ensure that any minor you are responsible for does the same. The presence of marshals at each site does not remove your obligation to supervise minors that you are responsible for.

3.4           All participants in a skating session at Mr Brown’s Roller Disco MUST WEAR appropriate clothing.  This means that you (and any minor you are responsible for) must wear socks with roller skates at all times.

4       YOU MUST NOT DO ANY OF THE FOLLOWING AT A ROLLER SKATING SESSION AT MR BROWN’S ROLLER DISCO:

4.1            I acknowledge that I MUST NOT and that I must ensure that any minors I am responsible for do not skate clockwise around the skating rink. Skating clockwise against the direction of other skaters can cause serious injury to participants.

4.2            I also acknowledge that I MUST NOT and that I must ensure that any minors I am responsible for DO NOT disobey any other general Mr Brown’s Roller Disco safety rules.

5       SUPERVISION OF PARTICIPANTS UNDER THE AGE OF 18:

5.1            I acknowledge that if I am responsible for a minor under the age of 13, I will ensure that I supervise them when participating in the skating session. I acknowledge that I know the capabilities of a minor I am responsible for and will make sure that I supervise appropriately.

6   REFUNDS

I acknowledge that if I am removed from a session or a minor I am responsible for is removed from a session for failing to comply with the requirements set out in this document I will not be entitled to any refunds of any money paid.

7   EPILEPSY

I understand that there may be flashing lights during my participation of the activities. I acknowledge that this will cause a risk if I have epilepsy and I will seek medical advice before participating in the activities if I have an epileptic condition. If I am responsible for a minor at a session I will ensure that I have clearance from a doctor or other appropriate medical practitioner before allowing them to take part.

8   OTHER IMPORTANT TERMS:

8.1        Food and Drink: I acknowledge that I cannot take part in a skating session whilst I am eating or drinking.  Eating includes chewing gum.

8.2       CCTV: Mr Brown’s Roller Disco operates CCTV at entrances and surrounding the premises. I accept that all CCTV images will be monitored and recorded and used for training, health and safety and security purposes. We will only keep the CCTV images for as long as necessary.

9   MR BROWN’S ROLLER DISCO LIABILITY:

This waiver does not exclude or limit Mr Brown’s Roller Disco liability where it would be unlawful to do so. We do not therefore limit or exclude liability for death or personal injury caused by Mr Brown’s Roller Disco’s negligence and that of our employees, agents and subcontractors, for fraud or fraudulent misrepresentation and any other liability that cannot be excluded or limited by English law.  Mr Brown’s Roller Disco is not responsible to you for loss and damage caused by a breach of these terms and conditions or by their negligence where this loss is not foreseeable.

10   MR BROWN’S ROLLER DISCO’S ABILITY TO REFUSE PARTICIPATION IN SKATING SESSIONS:

We reserve the right (at our discretion) to refuse to allow any person to take part in a session or remove them from a session if we consider that you are in breach of the terms set out above or any safety instructions or any advice given by marshals.

I agree to the requirements and terms set out above and acknowledge that there are risks involved in participating in a roller skating session. I also acknowledge that (subject to paragraph 9 above) Mr Brown’s Roller Disco cannot be liable to me to the extent that injury or loss or damage arises as a result of me not complying with the requirements set out above or failing to comply with any safety instructions or advice given to me by marshals.

 


MR BROWN’S ROLLER DISCO RULES

BEFORE YOU SKATE:

DO NOT SKATE if you have health limitations or injuries, are under the influence of
drugs, or are pregnant.

ALWAYS be aware of those around you.

It is YOUR RESPONSIBILITY to avoid others.

ALWAYS skate anti-clockwise

DO NOT affect another person’s skating in any way.

ALWAYS follow the Marshall’s directions.
